10-1E-6: USES; YARD AND BULK REQUIREMENTS:
The following schedule of uses and schedule of yard and bulk requirements and implementary regulations pertaining to the various zoning districts is hereby adopted and declared to be part of this chapter and may be amended in the same manner as any part of this chapter:
   A.   Use Groups: In each zoning district, any use group category not expressly permitted shall be deemed excluded. If there is question pertaining to interpretation of any specific use as to whether it does or does not come within the following express use groups, any applicant may apply to the board of zoning adjustment for the determination of whether a specific use is expressly permitted. Uses expressly permitted are designated "yes". Uses prohibited are designated "no", and uses permitted by special review are designated "R". (Ord. 130, 3-1-1978; amd. Ord. 316, 10-10-2002)
The use of property as a medical marijuana center, optional premises cultivation operation, or a facility for which a medical marijuana infused products manufacturers' license could otherwise be obtained from the town are all uses prohibited in any zoning district. (Ord. 395, 5-15-2012)
The renting or leasing of real property for residential occupation for periods of time less than thirty (30) days is prohibited in any zoning district within the town, except as permitted in this title for hotels, motels and bed and breakfast inns. (Ord. 421, 7-21-2015)

Notes to agricultural and residential use groups table:
      1.    Maximum number of units per building shall be 6.
      2.    Subject to other town ordinances and regulations.
      3.    Any such animals found roaming at large in nonagriculture districts are subject to capture by the town with no attempt to notify the owner, excluding dogs and cats.
      4.    Installations such as electric substations, sewer lift stations, etc., must be located more than 100 feet from residential units - no office, repair, storage or production facilities may be located in residential districts.
      5.    Sites on a lot of at least 2 acres in size with 25 foot setbacks on front, side and rear yards.
      6.    Subject to requirements on screening, grade of excavation, vehicular access and located 660 feet or further from schools and residential uses.

1. Facilities for the manufacturing, fabrication, processing or assembly of products; provided, that such facilities are completely enclosed and provided that no effects from noise, smoke, glare, vibration, fumes or other environmental factors are measurable at the property line

2. All other facilities for the manufacturing, fabrication, processing or assembly of products; provided, that such facilities are not detrimental to the public health, safety or general welfare and provided that the following performance standards are met:

a. Smoke: No operation shall be conducted unless it conforms to the standards established by the Colorado Department of Public Health's rules and regulations pertaining to smoke emission;
 
 
b. Particulate Matter: No operation shall be conducted unless it conforms to the standards established by the Colorado Department of Health's rules and regulations pertaining to emission of particulate matter;
 
 
c. Dust, Odor, Gas, Fumes, Glare Or Vibration: No emission of these matters shall result in a concentration at or beyond the property line which is detrimental to the public health, safety or general welfare or which causes injury or damage to property;
 
 
d. Radiation Hazards And Electrical Disturbances: No operation shall be conducted unless it conforms to the standards established by the Colorado State Department of Public Health's rules and regulations pertaining to radiation control;
 
 
e. Noise: No operation shall be conducted in a manner so that any noise produced is objectionable due to intermittence, beat, frequency or shrillness. Sound levels of noise at the property line shall not exceed 75 dBA, with a maximum increase of 4 dBA permitted for a maximum of 15 minutes in any 1 hour;
 
 
f. Water Pollution: No water pollution shall be emitted by manufacturing or other processing. In a case in which potential hazards exist, it shall be necessary to install safeguards acceptable to the Colorado State Department of Public Health, Water Pollution Control Division;
 
 
g. Visual Pollution: No operation shall be conducted that constitutes a severe visual nuisance according to the Town Board. In a case where such visual pollution exists, it shall be necessary to install screening acceptable to the Town Board.
