9-4-4: CONTRACT FOR COLLECTION AND DISPOSAL:
   A.   The City or its authorized representatives shall have authority to enter into contractual obligations with those who wish to engage in the business of refuse collection or refuse disposal for compensation in the City. The City shall be limited to contracting for such service to contract only with persons having proper equipment, meeting State Department of Health requirements, and sufficient personnel to collect and dispose of refuse in accordance with the provisions of this chapter; and provided further, that the method of disposal contracted for must be in accordance with the requirements of this chapter.
   B.   Every person, firm, organization, or other entity, governmental or nongovernmental, desiring to engage in the collection and disposal of refuse may make written application to the City setting forth the name of such person, firm, corporation or entity, governmental or nongovernmental, the residence address thereof, the names of all principal owners or stockholders; the names and residences of all officers and directors; the address of the place of business; a description of the equipment to be used in the collection or disposal of such refuse; and the place of disposal as well as the method of disposal to be utilized. Within forty five (45) days prior to the expiration of the current refuse collection contract, the City shall advertise for competitive bids for the trash collection and disposal contract for the City. All parties who have previously filed written application as above provided shall be notified by the City Clerk of the advertisement for bids. The contract shall be awarded to the lowest and best bidder as determined by the City Council. The contract shall be awarded within fifteen (15) days of the expiration of any existing contract. All contracts shall expire at eleven fifty nine o'clock (11:59) P.M. on June 30. The City Council may establish conditions of the contract including insurances and bonds that may be required, in their discretion.
   C.   Any person whose application has been denied may request and shall be granted a hearing before the City Council.
   D.   It is unlawful for any person who does not do so under a contract with the City to engage in the business of refuse collection or refuse disposal for compensation in the City.
