§ 62.003 BIDDING PROCEDURE
   (A)   Upon adoption of this chapter and in accordance with Section 164 of the Constitution of the Commonwealth of Kentucky, the city shall: (1) duly advertise for bids for a nonexclusive franchise, directing that all bids be submitted to the council of the city no later than 4:00 p.m. June 24, 1986; (2) publicly receive bids for a nonexclusive franchise; and (3) award a nonexclusive franchise to the best bidder, taking into consideration all factors held relevant thereto under the laws of the Commonwealth of Kentucky, recognizing that preference may be given to the number of channels and to channel selection, maintenance practices, installation and subscriber rates, experience in operating a system; provided, however, that the city expressly reserves the right to: (a) award more than one (1) nonexclusive franchise; (b) reject any or all bids for a nonexclusive franchise; (c) withhold the granting of any nonexclusive franchise. The city reserves the right to grant at any time such additional permits or franchises for additional cable communication systems as it deems appropriate.
   (B)   The City Clerk is hereby ordered and directed to duly advertise in accordance with the requirements of the law of the Commonwealth of Kentucky for bids for a nonexclusive franchise. Such advertisement shall provide that all bids shall contain the following information and provisions: (1) a schedule of the rates to be initially charged for services offered, as well as policy as to how and when the rates will be subject to change during the course of the franchise: (2) a provision that the CATV system shall have a minimum channel capacity of twelve (12) channels; (3) a schedule of such other services to be provided in the form of local access channels and services to public buildings; (4) the policy which will determine what areas of the city will be served; (5) any procedures for resolving subscriber grievances; and (6) any provisions regarding the establishment of a performance bond.
