§ 30.513 MISCELLANEOUS PROVISIONS
   Pretreatment charges and fees. The City of Morgantown Utilities Commission may adopt reasonable fees for reimbursement of costs of setting up and operating the City of Morgantown Utilities Commission Pretreatment Program, which may include:
   (A)   Fees for wastewater discharge permit applications including the cost of processing such applications;
   (B)   Fees for monitoring, inspection, and surveillance procedures including the cost of collection and analyzing a user's discharge, and. reviewing monitoring reports and certification statements submitted by users;
   (C)   Fees for reviewing and responding to accidental discharge procedures and construction;
   (D)   Fees for filing appeals;
   (E)   Fees to recover administrative and legal costs (not included in division (B)) associated with the enforcement activity taken by the Superintendent to address IU noncompliance; and
   (F)   Other fees as the City of Morgantown Utilities Commission may deem necessary to carry out the requirements contained herein. These fees relate solely to the matters covered by this article and are separate from all other fees, fines, and penalties chargeable by the City of Morgantown Utilities Commission.
   (G)   The City of Morgantown Utilities Commission may institute a surcharge on waste streams that contain more the 250 mg/1 BOD and/or 250 mg/1 TSS. The surcharge may be based on the pounds of BOD and/or TSS discharged. A surcharge may also be placed on Total Oil and Grease discharge that exceed 25 mg/1. This surcharge may also be based on the pounds of Total Oil and Grease discharged.
