§ 80.201  MODULAR HOMES
   (A)   Definitions.  The definition of terms used in this chapter shall be those set forth in KRS 360.150(C) and the Kentucky Housing Code, unless further defined herein.
   (B)   Modular homes shall include prefabricated, manufactured, or a factory built structure designed to be used as a dwelling.
   (C)   Modular homes shall not include mobile home, camping trailer, travel trailer, recreational vehicle, motor home, pickup camper or auto camper.
   (D)   Modular homes shall be considered standard housing and must comply with all applicable provisions of the Kentucky Building Code, the planning and zoning ordinance of the city, and bear a certificate either by the U.S. Department of Housing and Urban Development, or the Kentucky Department of Kentucky, Building and Construction Office of the State Fire Marshall, that the home has been constructed in accordance with the Federal Manufactured Home Construction and Safety Standards Act as set forth in Code of Federal Regulations, Title 24, Part 3280, 3282, 3283 and 42 U.S.C. 5401, et seq.
   (E)   Establishment, location and use of modular homes as site residences shall be permitted in any zone permitting installation of a single-family dwelling unit, subject to the requirements and limitations applying to such residential use in the district.
   (F)   Permits.
      (1)   A building permit shall be obtained.  The building inspector shall not issue a building permit unless a measured plot plan is submitted which shows the lot boundaries with the placement of the home, and which shows that the required building setback, side and rear yards are provided as required by regulations for the zone in which the home is to be placed.  No electric, water, sewer or natural gas shall be provided by any utility prior to the issuance of a building permit.
      (2)   A certificate of occupancy shall be obtained.  The building inspector shall issue a certificate of occupancy only after a personal inspection shows that provisions of this chapter pertaining to modular homes including compliance with the Kentucky Building Code have been complied with, and that the following conditions have been met:
         (a)   The modular home has been located on a lot of record in a manner consistent with the plot plan and that the required front setback, side and rear yards are provided consistent with the zone requirements.
         (b)   The support for the home may consist of a solid continuous foundation of concrete; but, at a minimum, shall consist of a concrete block foundation, twelve (12) inches in width or a stone foundation twelve (12) inches in width, and said foundation is to be placed twelve (12) inches of and from the top of the ground or according to the specifications set forth by the manufacturer of the home.
   (G)   No modular home may be occupied unless a certificate of occupancy has been issued after inspection by the building inspector.
