(A) Building Inspector. The Building Inspector, appointed by the County Commission, is hereby designated and authorized as the officer charged with the enforcement of this subchapter.
(B) Powers and duties. It shall be the duty of the Building Inspector to inspect or cause to be inspected all excavations at regular intervals, or as often as necessary. Where it is determined by the Building Inspector that excavation is proceeding not in compliance with the provisions of this subchapter, he or she shall enforce the provisions, and in performance of this duty may enter actions in the courts where necessary, and his or her failure to do so shall not legalize any violations of such provisions.
