(a) Medical studies have conclusively shown that exposure to secondhand smoke from tobacco causes illness and disease, including lung cancer, heart disease, and respiratory illness. The Village, in an effort to protect and enhance the health and well-being of all employees and to provide a clean, healthy, productive and safe environment for all, adopted this Village Campus-Wide Smoke Free Policy.
(b) Smoking is prohibited by Village employees on all Village Campus property and any other location where an employee is performing Village duties and responsibilities. The Village Campus includes Village Hall, the Police Department, the Service Department, the Building Department, the Community Center, the Jackson Valley Waste Water Treatment Plant, the Quail Hollow Waste Water Treatment Plant, the Woodland Glen Waste Water Treatment Plant, the Greentree Waste Water Treatment Plant, and any other property owned by, leased by, or under the control of the Village of Moreland, Hills, Ohio, including all internal and external areas, parking lots, entrances and exists. Smoking is also prohibited in all Village owned or Village leased vehicles.
(c) Village employees who choose to use tobacco products must do so during their regularly scheduled breaks or meal periods and off Village property.
(d) Employees may smoke in their personal vehicles, however, the smoke must be completely contained within the vehicle. It is not acceptable that either smoking or non- smoking employees are subjected to smoke that they must walk through to reach their vehicle or any other destination on Village property. Smoking in personal vehicles is prohibited when transporting persons on Village business.
(e) Violations of the Village Campus-Wide Smoke Free Policy shall be reported to the Department Manager. If the Department Manager is unavailable or if the Department Manager participated in the violation, the employee should contact the Mayor.
(f) Failure to Comply with the Village Campus-Wide Smoke Free Policy. Failure of employees to comply with the Village Campus-Wide Smoke Free Policy will result in disciplinary action, up to and including termination.
(g) Retaliation Prohibited. The Village and its employees shall not discharge or in any manner retaliate against an employee who reports a violation of the Village Campus-Wide Smoke Free Policy. Such employee, however, may be discharged or disciplined for other violations and/or performance problems. (Ord. 2016-16. Passed 3-9-16.)
