141.03 WORK PERIOD; OVERTIME; COMPENSATORY TIME; AND COMPENSATION FOR COURT APPEARANCES WHEN NOT ON DUTY.
   (a)   Non-exempt employees of the Police Department shall work 80 hours within a fourteen day work period as scheduled by the Chief of Police.
      (1)   All hours worked in excess of 80 within a fourteen day work period shall be compensated at one and one-half times the base rate of the employee's pay although the Chief of Police may compensate such work with compensatory time.
      (2)   Overtime compensation (in premium pay or compensatory time as agreed by the Chief of Police and the employee) shall be paid to employees of the Police Department for work performed in excess of 80 hours during such fourteen day period at one and one-half times the base rate.
      (3)   At no time shall compensatory time accumulate in excess of 40 hours per year. Accumulated compensatory time, at the employee's option, must be used before the end of the calendar year in which it was earned or paid as overtime to the employee at the end of the calendar year in which it was earned. Upon termination of service, the employee or his/her estate shall be compensated for any unused, accumulated compensatory hours as overtime at the employee's pay rate at the time of termination. Compensatory time off may be used in increments of not less than one hour.
      (4)   The employee is permitted to use the compensatory time at the employee's discretion within a reasonable time after the time the compensatory time is earned and provided the absence due to the compensatory time will not unduly disrupt the department's operations.
   (b)   (1)   A sworn employee of the Police Department appearing in court, on Village business, in response to a subpoena is entitled to receive a minimum of three (3) hours compensation, at the employee's regular rate of pay, regardless of the time expended in court, when a subpoena is issued for a date and time when the employee is not on duty.
      (2)   In the event that an employee has more than one court appearance scheduled on one day, the employee may only receive the minimum three (3) hours compensation once unless there are three (3) or more hours between the scheduled court times. The minimum three (3) hours compensation for a court appearance shall not be paid to an employee who, after issuance of a subpoena, adjusts his or her schedule in a manner that enables the employee to be off duty on the date of the subpoena and shall not be paid if the employee's subpoena is cancelled prior to 11:00 p.m. the night before the employee is to appear in court.
      (3)   An off-duty employee appearing in court and eligible for the minimum three (3) hour compensation for court appearance who is then called to duty within the three (3) hours for court appearance shall only receive compensation for such time once. There shall be no overlapping of the minimum three (3) hours payments for court appearances and on-duty compensation.
      (4)   An employee requesting the minimum three (3) hours compensation for court appearance shall report the number of hours actually worked and this number, not the minimum three (3) hours compensation for court appearance, shall be used to determine all hours worked for purpose of overtime.
      (5)   The Mayor is authorized to issue Rules and Regulations relating to this minimum three (3) hours compensation for court appearances as may be necessary. (Ord. 2016-16. Passed 3-9-16.)
