§ 154.175 DOWNTOWN PARKING OVERLAY DISTRICT.
   The following regulations apply to properties within the Downtown Parking Overlay District.
   (A)   Applicability. Properties located within the Downtown Parking Overlay District shall be subject to the parking requirements of this chapter, unless specifically exempted within this section.
   (B)   Reduction in number of spaces. The City Planner may approve a reduction in the number of required parking spaces as specified in Table 174-1 : Off-Street Parking Space Requirements up to thirty (30) percent for properties within the Downtown Parking Overlay District.
   (C)   Location. Such spaces shall be located on the same lot containing the use for which they are required or within separate lots or structures located within one thousand (1,000) feet of the lot containing the use for which they are required. A parking agreement is required for all off-site parking agreements and shall be submitted to the City Planner for review and approval.
   (D)   Adding and removal of properties from overlay. Properties can be added or removed from the Downtown Parking Overlay District subject to the process established in § 154.123 : Zoning Text and Map Amendments.
   (E)   Geographical boundaries of the Downtown Parking Overlay District. The geographical boundaries of the Downtown Parking Overlay District in the city lies within and adjacent to the following description:
      Beginning at the intersection of Main Street and Wilkinson Blvd on East Main (38.188923 N – 83.426447 W), thence westward on Main Street to Elizabeth Ave on East Main Street (38.186793N - 83.431169 W), thence northward to East Second Street (38.187353N – 83.431945W) thence westward on East Second Street to Flemingsburg Rd (38.178795N – 83.440402W), thence southward on Flemingsburg Rd (38.176914N – 83.435810W) to Wilkinson Boulevard (US 60) (38.176914N -83.435810W), thence eastward on Wilkinson boulevard to the intersection of Wilkinson Boulevard and Main Street (38.188923N, -83.426447W).
      This description takes in the area and parcels between Second Street and First Street that are bounded by KY 32 and the intersection of East Second Street and Elizabeth Avenue and bounded by the intersection of East Main Street and Wilkinson Boulevard.

only apply to businesses and/or business properties within the Downtown Parking Overlay District. The parking requirement of this chapter shall not apply to residential parking or properties within the defined geographical area in subsection (E) above.
   (G)   Compliance. Nothing in this section shall be construed to authorize noncompliance with any state statue or local ordinance or policy.
