§ 102.99 PENALTY.
   (A)   For any alarm system that has four (4) or more false alarms in a calendar year at the same address, the owner shall be issued a Notice of Violation by a Code Enforcement Officer. If the Notice of Violation is not contested, the following civil fines shall apply:
      Fourth False Alarm    $ 25.00
      Fifth False Alarm    $ 60.00
      Sixth False Alarm    $125.00
      Seventh False Alarm    $200.00
   (B)   If the owner contests the citation and request a hearing before the Code Enforcement Board or fails to pay the penalty within the time period allowed, the following maximum penalties may be imposed at the discretion of the Code Enforcement Board:
      Fourth False Alarm    $ 50.00
      Fifth False Alarm    $100.00
      Sixth False Alarm    $200.00
      Seventh False Alarm    $300.00
   (C)   If there is an eighth false alarm, then the address shall be placed on a listing of addresses for "No Calls of Service Initiated by Faulty Alarm Systems". This listing shall be maintained and controlled by the Chief of Police or his/her designee. All dispatchers shall be made aware of the listing. An address that has been placed on the listing for "No Calls of Service" shall be returned to normal status if the system owner can demonstrate with documentation that the malfunctioning system has been repaired or replaced and all penalties have been paid in full. The status change must be approved by the Chief of Police or his/her designee.
