§ 34.30 POWERS AND DUTIES.
   (A)   The Commission shall have general powers necessary to carry out its functions in accordance with this section and KRS Chapter 100. The Commission may be assigned any powers, duties and functions related to urban renewal or public housing by the legislative body of the City of Morehead, City of Lakeview Heights or the County of Rowan.
   (B)   The commission shall have the following additional power to review and, approve or reject any of the following developments and constructions:
      (1)   A subdivision as established and defined by KRS Chapter 100.111;
      (2)   Any development consisting of three or more dwelling units per parcel. A dwelling unit is defined as a structure or the part of a structure that is used as a home, residence, or sleeping place by one (1) person who maintains a household or by two (2) or more persons who maintain a common household.
      (3)   Any business, commercial, industrial or public zone construction development;
      (4)   Any construction of any structure more than three (3) stories or thirty (30) feet in height in any zone;
      (5)   Any construction of any live entertainment facility;
      (6)   Any new mobile home park development.
      (7)   Any change of use.
   (C)   With regard to the powers listed in division (B) above, the applicant shall submit a preliminary development plan and a final plan to the Commission as outlined in § 154.125 of the City of Morehead Code of Ordinances. The commission may waive the requirement of submission of said preliminary development plan.
