159.01 COMPETITIVE BIDDING.
   (a)    Except as herein otherwise set forth, the minimum threshold for competitive bidding for goods and services for the City of Moraine, Ohio shall be fifty thousand dollars ($50,000).
   (b)   The following expenditures may be exempted by Council from competitive bidding:
      (1)   Goods and services which can be at State Bid Pricing pursuant to Ohio R.C. 125.04 and goods and services which can be obtained from sources at a price less than the State bid price as provided for in Ohio R.C. 125.04(B) may be purchased by the City of Moraine, Ohio, without the necessity of competitive bidding provided the request to Council contains all appropriate information demonstrating compliance with this provision;
      (2)   Intergovernmental contracts or expenditures and purchases and expenditures made via participation in a cooperative purchasing program;
      (3)   Where there exists only a sole source to provide the needed goods or services;
      (4)   Emergency contracts or expenditures authorized by a vote of two-thirds of the members of Council;
      (5)   Other exceptions to the requirements of competitive bidding as set forth by the general laws or established by the common law of the State of Ohio.
