128.01 DEFINITIONS.
   As used in this chapter, certain terms are defined as follows:
   (a)    "Clerk" means the Clerk of Council.
   (b)    "Day" means a calendar day.
   (c)    "Meeting" means any prearranged discussion of the public business of the municipal body by a majority of the members of the municipal body.
   (d)    "Executive session" means a discussion held outside the hearing of the public and news media for the sole purpose of the consideration of any of the following matters:
      (1)    Unless the public employee, official or licensee requests a public hearing, to consider the appointment, employment, dismissal, discipline, promotion, demotion or compensation of a public employee or official or the investigation of charges or complaints against a public employee, official or licensee of the Municipality;
      (2)    To consider the purchase of property for public purposes, or for the sale of property at competitive bidding, if premature disclosure of information would give an unfair competitive or bargaining advantage to a person whose personal or private interest is adverse to the general public interest;
      (3)    Conferences with an attorney for the Municipality concerning disputes involving the Municipality, Council, boards, commissions, officials and employees of the Municipality that are the subject of pending or imminent court action;
      (4)    Preparing for, conducting or reviewing negotiations or bargaining sessions with public employees and officials of the Municipality concerning their compensation or other terms and conditions of their employment;
      (5)    Matters required to be kept confidential by federal law or rules or state statutes;
      (6)    Specialized details of security arrangements where disclosure of the matters discussed might reveal information that could be used for the purpose of committing or avoiding prosecution for a violation of the law.
   (e)    "Municipal body" means each of the following: Council, Planning Commission, Board of Zoning Appeals, Merit System Commission, Parks and Recreation Board, Board of Tax Appeals, Voluntary Firemen's Fund, Grievance Committee, Community Housing Council, Mobile Home Repair Loan Committee, Transportation Committee, Tax Abatement Committee and committees of the above municipal bodies comprised of members of such bodies if such committees are comprised of a majority of the members of the main municipal body, or are decision-making committees.
   (f)    "Oral notification" means notification given orally either in person or by telephone, directly to the person for whom such notification is intended, or by leaving an oral message for such person at the address, or if by telephone at the telephone number, of such person as shown on the records kept by the Clerk.
   (g)    "Post" means to post in an area accessible to the public during the usual business hours at the office of the Clerk and at the following locations: Family Market and Civic Center. A notice identifying the locations at which notifications shall be posted shall be published by the Clerk within ten calendar days after the adoption of this chapter.
   (h)    "Published" means published once in a newspaper having a general circulation in the Municipality, except that no portion of such newspaper need be printed in the Municipality.
   (i)    "Special meeting" means a meeting which is neither a regular meeting nor an adjournment of a regular or special meeting to another time or day to consider items specifically stated on the original agenda of such regular or special meeting.
   (j)    "Written notification" means notification in writing mailed or delivered to the address of the person for whom such notification is intended as shown on the records kept by the Clerk of Council, or in any way delivered to such person. (Ord. 681. Passed 4-14-83.)
