The purpose of this ordinance is to provide for the health, safety, and general welfare of the citizens of Moraine through the regulation of non-storm water discharges to the storm drainage system to the maximum extent practicable as required by federal and state law. This ordinance establishes methods for controlling the introduction of pollutants into the municipal separate storm sewer system (MS4) in order to comply with requirements of the National Pollutant Discharge Elimination System (NPDES) permit process. The objectives of this ordinance are:
(a) To regulate the contribution of pollutants to the municipal separate storm sewer system (MS4) by storm water discharges by any user.
(b) To prohibit illicit Connections and Discharges to the municipal separate storm sewer system.
(c) To establish legal authority to carry out all inspection, surveillance and monitoring procedures necessary to ensure compliance with this chapter.

(d) To establish enforcement procedures to ensure compliance with this chapter.
The City’s OEPA NPDES permit (OHQ000004 or latest version) for authorization to discharge storm water requires a Storm Water Management Plan (SWMP) that satisfies the appropriate water quality requirements of ORC 6111 and the USEPA Clean Water Act. The SWMP describes the best management practices (BMPs) selected by the City to meet the requirements of the six minimum control measures identified in the permit. Illicit discharge detection and elimination is one of the minimum control measures. An Illicit Discharge Detection and Elimination (IDDE) Plan is required as part of the permit. The IDDE Plan is the City’s plan to detect and eliminate illicit discharges and connections to the MS4. Requirements of the latest versions of the SWMP and IDDE Plan shall be part of these regulations.
