927.04 PERMIT SUSPENSION OR REVOCATION; RENEWAL REFUSAL.
   (a)    Permits to operate any structure or device for the disposal of garbage or other waste materials issued pursuant to this chapter may be suspended or revoked by the City Engineer after an opportunity for a hearing before Council, upon violation by the permittee of any of the terms of the regulations and requirements contained in this chapter.
   (b)    Notices of violations of any item or section of these regulations and requirements shall be given the person responsible for the permit and/or operation of the facilities in writing by the City Engineer. Abatement of the nuisance or correction of the condition complained of shall be made within the time designated by the City Engineer in the notice or suspension shall be automatic.
   (c)    If two or more notices, covering the same violation, are received by the person responsible for the permit and/or operation of the facilities from the City Engineer during any one period of sixty days, the permit shall be automatically suspended and the same shall be grounds for revocation. An assessment of one hundred dollars ($100.00) will be levied to cover the costs of any hearing on suspension or revocation. If, in the opinion of Council, an excessive number of written violations are issued by the City Engineer against any one permittee in any permit year, the renewal permit for the following year may be refused.
   (d)    The refusal for renewal of a permit by Council because of frequent or continued violations is permanent and shall not be renewed or re-established.
