927.01 PERMIT APPLICATION; PLANNING COMMISSION HEARING.
   (a)    No person shall dump or deposit any garbage or other waste materials of any kind on any public or private property within the City, nor shall any incinerator, landfill, sanitary landfill or other structure or device for the disposal of garbage or other waste materials be established, erected or operated with the City, without a permit duly issued as provided herein. For purposes of this chapter any such incinerator, landfill, sanitary landfill or other structure or device for the disposal of garbage or other waste materials is conclusively presumed to be within the City if any part of the waste processing or disposal facilities and operations are located in or transverse any area of the City. The permit required herein shall be in addition to any permits required by any other Federal or State governmental unit or subdivision. The expansion of any existing landfill or disposal operation shall require a separate permit issued pursuant to this chapter.
   (b)    Applications for such permits shall be sworn to by the applicant and filed with the City Engineer setting forth the following information:
      (1)    Name and address of applicant which will conduct the operation. Name of all parties in partnership, identity of all corporate officers, if incorporated.
      (2)    Name and address of the person responsible for permit application and/or the operation of the facilities.
      (3)    Name and address of owner(s) of the land upon which the operation will be located and conducted.
      (4)    Legal description and U.S.G.S. map location of facility.
      (5)    The source, type and volume of wastes, together with daily waste quantity estimates.
      (6)    Detailed plans and maps of the facility and the proposed methods of collection, storage and disposal including compaction and covering practices, litter control, noise control, traffic control, dust control and all equipment to be used in the activity.
      (7)    Such other pertinent and additional data as may be deemed necessary to enable the Planning Commission to determine the nature and scope of the proposed operation.
   (c)    The application shall be processed by the City Engineer and forwarded to the Planning Commission for hearing. The Planning Commission shall then set a date for a public hearing on the application and forward its recommendation to Council. Notice and time requirements shall be as are set forth in Section 7-2 of the Charter. In arriving at its recommendations, the Planning Commission shall use as a criteria whether the waste disposal facilities and activities proposed in the application pose no reasonable probability of adverse effects on health or the environment. The Planning Commission shall make a specific finding as to whether the waste disposal facilities or practices will contaminate an underground drinking water source. (Ord. 576. Passed 6-12-80.)
