734.10 SUSPENSION OF PERMIT.
   The City Manager, or person designated by the City Manager, shall suspend a permit for such a business for a period not to exceed thirty (30) days, if he/she determines that a permittee, employee, or independent contractor of a permittee, has:
   (a)   Violated any part of this chapter; or
   (b)   Been under the influence of alcoholic beverages or controlled substances as defined in the Moraine Code of Ordinances, while working in or on the sexually oriented business premises; or
   (c)   Knowingly permitted illegal gambling by any person on the sexually oriented business premises; or
   (d)   Engaged in the transfer of a permit contrary to Section 734.13. In the event that the City Manager, or person designated by the City Manager, suspends a permit on the ground that a permittee engaged in the transfer of a permit contrary to Section 734.13, The City Manager, or person designated by the City Manager, shall forthwith notify the permittee of the suspension; or
   (e)   Operated the sexually oriented business in violation of the hours of operation in Section 734.21; or
   (f)   Knowingly employs a person who does not have a valid permit as required in Section 734.14;
   (g)   The suspension shall remain in effect until the violation in question has been corrected if it is a continuing violation;
   (h)   Appeal: The process set out in Section 734.28 shall apply to any suspension. The existing permit shall remain in effect until the appeal process in Section 734.28 shall have concluded.
