725.01 DEFINITIONS.
   Except where otherwise indicated by the context, the following definitions shall apply in the interpretation and enforcement of this chapter:
   (a)    "Person" means any person, firm, partnership, association, corporation, company or organization of any kind.
   (b)    "Junk" means old iron, steel, brass, copper, tin, lead or other base metals; old cordage, ropes, rags, fibers or fabrics; old rubber; old bottles or other glass; bones; wastepaper and other waste or discarded material which might be prepared to be used again in some form; and any or all of the foregoing; and motor vehicles, no longer used as such, to be used for scrap metal or stripping of parts; but "junk" does not include materials or objects accumulated by a person as byproducts, waste or scraps from the operation of his own business or materials or objects held and used by a manufacturer as an integral part of his own manufacturing processes.
   (c)    "Junkyard" means a yard, lot or place, covered or uncovered, outdoors or in an enclosed building, containing junk as defined above, upon which occurs one or more acts of buying, keeping, dismantling, processing, selling or offering for a business or commercial purpose, whether or not the proceeds from such act or acts are to be used for charity. Junkyard also includes scrap metal processing facilities or any site, location or premises on which are kept two or more junk motor vehicles, whether or not for a commercial purpose or any place which is maintained, used or operated for storing, keeping, buying, selling, wrecked scrap ruined or dismantled motor vehicles or vehicle parts.

(d)    "Junk or Secondhand Dealer" means a person who operates a junkyard, secondhand shop, store or other similar place of business within the City. It does not include persons dealing primarily in the purchase and resale of used and secondhand furniture. It also does not include persons who accept trade-ins on an infrequent basis or as an incidental aspect of their business.

(e)    "Fence" means a barrier at least six feet in height, constructed of nontransparent materials and maintained so as to obscure the junk from the ordinary view of persons in the City.
(f)    "Scrap metal processing facility" means an establishment having facilities for processing iron, steel and nonferrous scrap and whose principal product is scrap iron and steel or nonferrous material.
(g)    "Business premises" or "premises" means the area of a junkyard as described in a junk dealer's license or application for license, as provided for in this chapter. (Ord. 453. Passed 2-23-78.)
   (h)   "Secondhand shop or store" means a business which engages in the buying and/or selling of goods that are not new and includes but is not limited to thrift stores, coin shops, surplus stores and similar type businesses. It does not include persons who accept trade-ins on an infrequent basis or as an incidental aspect of their business.
