§ 33.03 DISPOSITION OF UNCLAIMED PERSONAL PROPERTY.
   (A)   Any item of personal property that shall come into the possession of the city, in the course of municipal operations, and shall remain unclaimed by its owner for at least ninety (90) days, shall be sold by the city as hereinafter provided.

   (B)   (1)   This sale shall be open to the general public and shall be held only after there has been at least 10 days published and posted notice of the sale. The notice shall specify the time and place of the sale and shall, in general terms, list the articles to be offered for sale. The notice shall specify a time prior to the sale when the articles may be viewed by prospective purchasers. The sale shall be under the management and direction of the City Clerk-Treasurer.
      (2)   The sale shall be by auction or by accepting sealed written bids. The method to be used
shall be in the discretion of the City Clerk-Treasurer.
      (3)   The published notice shall indicate if the sale shall be by auction or receipt of written bids.

   (C)   If no bids shall be received for any articles, the City Clerk-Treasurer shall furnish a list of the items to the Council with an estimate of their value. The City Council may then direct the disposition in any manner it deems to be reasonable.

   (D)   The funds received from any such sales shall be paid into the General Fund of the city. The funds shall be held by the city for six (6) months from the date of the sale, subject to the right of the former owner to payment of the sale price from the fund if the owner can give satisfactory proof of ownership.
