§ 117.03 LICENSE REQUIRED.
   (A)   There shall be two (2) classes of licenses for the collection of solid waste.
      (1)   Mixed municipal solid waste (MMSW) collection license. This license shall be for regularly scheduled collection service to customers of MMSW.
      (2)   Roll-off service solid waste collection license. This license shall be for occasional service to customers where the type and amount of solid waste generated is greater than can be accommodated through MMSW collection.
   (B)   No person, firm, corporation or other entity shall contract for the collection or collect solid waste in the city without first securing a license from the city. The City Council, in the interest of maintaining healthful and sanitary conditions in the city, hereby limits the number of MMSW collector licenses issued to three (3). There shall be no limit on the number of roll-off service solid waste collection licenses issued. No person or business entity shall permit solid waste to be collected from his or her premises for hire by an unlicensed collector.
   (C)   The annual license fee shall be established in an amount set by the City Council from time to time.
   (D)   Any license issued under this chapter shall be nontransferable.
   (E)   No license shall be required by any person, firm, corporation or other entity for purposes of collecting, hauling or disposing of their own mixed municipal solid waste; provided that any collection, hauling and/or disposal shall be done in a lawful manner.
