§ 90.53 EXEMPTIONS.
   Dogs may not be declared dangerous if the threat, injury, or damage was sustained by a person:
   (A)   Who was at the time of injury committing or attempting to commit willful trespass or other tort or crime upon the premises occupied by the dog;
   (B)   Who was provoking, tormenting, teasing, abusing or assaulting the dog or who can be shown to have repeatedly, in the past, provoked, tormented, teased, abused or assaulted the dog; or
   (C)   Who was injured by a dog or dogs used by law enforcement personnel within the scope of their duty.
