9-2-6: MECHANICAL AND ELECTRICAL REQUIREMENTS:
   A.   General:
      1.   Scope: The provisions of this chapter shall govern the minimum mechanical and electrical facilities and equipment to be provided.
      2.   Responsibility: No owner, manager, or occupant shall cause any surface, facility, equipment or utility which is required under this chapter to be removed, shut off or disconnected for any occupied dwelling let or occupied by him/her except for such temporary interruption as may be necessary while actual repairs or alterations are in process, or during temporary emergencies when discontinuance of service is approved by the agency having jurisdiction. No occupancy shall occur in any dwelling or dwelling unit which does not meet all minimum standards for clean, sanitary, safe and fit housing.
   B.   Heating Facilities:
      1.   Facilities Required: Heating facilities shall be provided in structures as required by this subsection. (Ord. 2004-28, 10-18-2004)
      2.   Residential Occupancies: Dwellings shall be provided with heating facilities capable of maintaining a room temperature of sixty eight degrees Fahrenheit (68°F) in all habitable rooms, bathrooms and toilet rooms. (Ord. 2016-13, 7-25-2016)
      3.   Heat Supply: Every owner and manager of any building who rents, leases or lets one or more dwelling units, rooming units or guestrooms on terms, either express or implied, to furnish heat to the occupants thereof shall supply heat during the appropriate season to maintain a temperature of not less than sixty eight degrees Fahrenheit (68°F) in all habitable rooms, bathrooms, and toilet rooms. Every dwelling unit shall have access to the heating thermostat controls for its heating supply. If such control is not or cannot be readily accessible at all times, installation of separate heat controls, under a proper heating permit, will be required in each dwelling unit to provide accessibility. All heat controls shall be properly installed and maintained in good working order. (Ord. 2004-28, 10-18-2004)
      4.   Occupiable Workspaces: Indoor occupiable workspaces shall be supplied with heat during the appropriate season to maintain a temperature of not less than sixty eight degrees Fahrenheit (68°F) during the period the spaces are occupied. Exceptions:
         a.   Processing, storage and operation areas that require cooling or special temperature conditions.
         b.   Areas in which persons are primarily engaged in vigorous physical activities.
      5.   Room Temperature Measurement: The required room temperatures shall be measured three feet (3') (914 mm) above the floor near the center of the room and two feet (2') (610 mm) inward from the center of each exterior wall.
   C.   Mechanical Equipment:
      1.   Mechanical Equipment: All mechanical equipment, fireplaces and solid fuel burning appliances shall be properly installed and maintained in a safe working condition, and shall be capable of performing the intended function. When the furnace system is natural gas or propane, a properly installed and maintained manual shutoff valve shall be present and accessible within six feet (6') of each gas line to appliance connection.
         a.   Mechanical Equipment Hazards: Where it is found that mechanical equipment is not properly installed, maintained and/or performing its intended function, the code official shall require the defects to be corrected to eliminate the hazard. A letter from a licensed professional is required verifying that corrections have been made to the listed mechanical deficiencies. Such certification of safe and adequate conditions must be sent to the code official.
      2.   Cooking And Heating Equipment: All cooking and heating equipment, components and accessories in every heating, cooking and water heating device shall be maintained in good working order.
         a.   Cooking Equipment: Cooking appliances shall not be used to provide space heating to meet the minimum requirements of subsection B3 of this section.
      3.   Removal Of Combustion Products: All fuel burning equipment and appliances shall be connected to an approved chimney or vent.
      4.   Clearances: All required clearances to combustible materials shall be maintained.
      5.   Safety Controls: All safety controls for fuel burning equipment shall be maintained in effective operation.
      6.   Combustion Air: A supply of air for complete combustion of the fuel and for ventilation of the space containing the fuel burning equipment shall be provided for the fuel burning equipment.
      7.   Energy Conservation Devices: Devices intended to reduce fuel consumption by attachment to a fuel burning appliance to the fuel supply line thereto, or to the vent outlet or vent piping therefrom, shall not be installed unless labeled for such purpose and the installation is specifically approved by the appliance manufacturer and local jurisdiction having control.
   D.   Electrical Facilities:
      1.   Facilities Required: Every occupied building shall be provided with an electrical system in compliance with the requirements of this subsection and subsection E of this section.
      2.   Service: The size and usage of appliances and equipment shall serve as a basis for determining the need for additional facilities in accordance with the NEC electrical code. Every dwelling shall be served by a main service that is not less than sixty (60) amperes, three (3) wires.
      3.   Electrical System Hazards: Where it is found that the electrical system in a structure constitutes a hazard to the occupants or the structure by reason of inadequate service, improper fusing, insufficient outlets, improper wiring or installation, deterioration or damage, or for similar reasons, the code official shall require the defects to be corrected to eliminate the hazard. Certification of an upgrade condition by a licensed electrician must be sent to the department of rental property maintenance inspection office after completion.
   E.   Electrical Equipment:
      1.   Installation: All electrical equipment, wiring and appliances shall be properly installed and maintained in a safe and approved manner as required by the NEC electrical code. Extension cords shall not be used as a substitute for permanent wiring. Extension cords shall be used only with portable appliances. Extension cords shall be plugged directly into an approved receptacle, power tap or multiplug adapter and shall, except for approved multiplug extension cords, serve only one portable appliance. The ampacity of the extension cords shall not be less than the rated capacity of the portable appliance supplied by the cord. The extension cords shall be maintained in good condition without splices, deterioration or damage.
      2.   Receptacles: Every habitable space in a dwelling shall contain at least two (2) separate and remote receptacle outlets. Every laundry area shall contain at least one grounded type receptacle or a receptacle with a ground fault circuit interrupter. Every bathroom shall contain at least one receptacle. Any new bathroom receptacle outlet shall have ground fault circuit interrupter protection.
      3.   Lighting Fixtures: Every public hall, interior stairway, toilet room, kitchen, bathroom, laundry room, boiler room and furnace room shall contain at least one electric lighting fixture.
   F.   Elevators, Escalators And Dumbwaiters:
      1.   General: Elevators, dumbwaiters and escalators shall be maintained to sustain safely all imposed loads, to operate properly, and to be free from physical and fire hazards. The most current certificate of inspection shall be on display at all times within the elevator or attached to the escalator or dumbwaiter; or the certificate shall be available for public inspection in the office of the building owner or manager.
      2.   Elevators: In buildings equipped with passenger elevators, at least one elevator shall be maintained in operation at all times when the building is occupied.
Exception: Buildings equipped with only one elevator shall be permitted to have the elevator temporarily out of service for testing or servicing.
   G.   Duct Systems:
      1.   General: Duct systems shall be maintained free of all obstructions and shall be capable of providing the required function. (Ord. 2004-28, 10-18-2004)
