8-4-30: PROTECTION OF WORK WITHIN THE RIGHT-OF-WAY:
The permittee shall be responsible for barricading the work within the right-of-way in conformance with the current version of the Manual On Uniform Traffic Control Devices (MUTCD) as adopted by the Minnesota Department of Transportation.
   A.   Protective Measures And Routing Of Traffic:
      1.   It shall be the duty of every person performing work in or upon any public place or right-of-way, to place and maintain barricades and warning devices necessary for the safety of the general public. Warning signs shall be placed far enough in advance of the construction operation to alert traffic within a public street, and cones or other devices shall be placed to channel traffic. All safety precautions and traffic-control measures shall conform to the current requirements as specified in the latest edition of the Uniform Traffic Control Manual as adopted by the Minnesota Department of Transportation.
      2.   The permittee shall take appropriate measures to assure that, during the performance of the excavation work, traffic conditions, as near normal as possible, shall be maintained at all times so as to minimize inconvenience to the occupants of the adjoining property and to the general public. Adequate pedestrian passageways shall be maintained.
      3.   The permittee shall maintain safe crossings for two (2) lanes of vehicular traffic at all street intersections, where possible. If any excavation is made across any public street, alley, trail, sidewalk or established crosswalk, adequate crossings through or around the work zone shall be maintained for vehicles and for pedestrians where possible. Where it is not possible to maintain traffic through the work zone, the permittee shall detour traffic using signage in accordance with the MUTCD and a detour plan as approved by the Director or his designee.
      4.   The City may permit the closing of streets and alleys for a prescribed period of time. The City may require that the permittee give notification to various public agencies and to the general public before approval becomes valid. In specific instances, even though the street may not be closed, the permittee may also be required to give such notice.
   B.   Protection Of Adjoining Property: The permittee shall at all times preserve and protect from injury any adjoining property by providing adequate support and taking other necessary measures. The permittee shall, at its own expense, shore up and protect all buildings, walls, fences or other property likely to be damaged during the progress of the work and shall be responsible for all damage to public or private property resulting from said work.
