8-3-5: REGULATIONS RELATING TO DRIVEWAY APPROACHES AND RELATED ELEMENTS:
The following regulations apply to all driveway approaches and related elements constructed within the City of Moorhead: (Ord. 2006-1, 3-6-2006)
   A.   All residential driveway approaches and related elements within the road right-of-way must be at least six inches (6") thick, and must be no less than nine feet (9') wide at the sidewalk line, and must be so located so as to provide access to a parking space within the property to be served. All commercial and industrial driveway approaches and related elements within the road right-of-way must be at least seven inches (7") thick.
   B.   Driveways must be constructed in accordance with all of the requirements of this section and in accordance with the current driveway specifications available at the Office of the City Engineer.
   C.   The width of residential driveways, other than attached single-family lots, may not exceed one-half (½) of the frontage of the lot on the street to which the driveway will connect or thirty feet (30'), whichever is less. For attached single- family lots, the driveway may not exceed the width of the building on the lot, or thirty feet (30'), whichever is less. Exception: Lots that measure one hundred feet (100') or more in lot width may have up to two driveway approaches not to exceed a total combined width of forty feet (40'). In commercial and industrial areas the driveway width may not exceed one-half (½) of the frontage of the lot on the street to which the driveway will connect, or forty feet (40'), whichever is less. Provided, for commercial and industrial driveways, upon approval of the City Engineer, or his designee, driveways may be constructed up to one-half (½) of the frontage of the lot on the street to which the driveway will connect, even if it exceeds forty feet (40').
   D.   The maximum width of the driveway shall be measured at the intersection of the sidewalk. If there are two (2) driveway accesses on the same lot, the combined total driveway width of both driveways may not exceed the width restrictions set out above except for lots in all RLD and RMD-1 Zones with frontage on two (2) local streets in which case the width restrictions set out above apply individually to a driveway to each local street. All lots in all RLD Zones and the RMD-1 Zone may have only one driveway on the same street, except for multi-family units of nine (9) or more units may have two (2) driveways on the same street. Single-family homes in any zoning district are limited to one driveway on the same street.
   E.   A driveway may be no closer than twenty feet (20') from the right-of-way line of a street with a functional classification of local, and no closer than thirty feet (30') from the right-of-way line of a street with a functional classification of collector or arterial. No driveways, however, will be permitted to enter into a designated right turn lane on any street.
   F.   Driveway spacing shall not be less than six hundred sixty feet (660') on collector streets and one thousand three hundred twenty feet (1,320') on arterial streets without the approval of the Planning Commission and City Engineer. (Ord. 2012-14, 8-27-2012; amd. Ord. 2022-10, 4-25-2022)
