Any person violating any of the provisions of this chapter may be charged with an administrative offense pursuant to section 1-4-5 of this code, or alternatively, a criminal offense if a violation is committed in a manner or under circumstances so as to endanger or be likely to endanger any person or property. If charged with a criminal offense and convicted, the person shall be penalized in accordance with the provisions of section 1-4-2 of this code. The determination as to whether to treat a violation as an administrative offense or as a criminal offense shall be up to the discretion of the authority issuing the citation. Any vehicle parked in violation of any of the provisions of this chapter may be impounded, and no person shall recover any vehicle impounded pursuant to this section without first paying the impound fees and charges as established by the city's fee schedule.
