3-4-9: RECYCLABLE MATERIAL:
   A.   Purpose: The purpose of this section is to reduce the amount of waste generated in the City by voluntarily disposing of recyclable materials either through no-sort recycling methods or through separation of recyclable materials.
   B.   No-Sort Recycling: Single dwelling housing and multidwelling housing units are authorized to participate in no-sort recycling unless otherwise authorized by the Public Works Director.
The City will provide totes to all single dwelling homes and containers or dumpsters for multiple dwelling homes. Damaged totes, containers, and dumpsters will be replaced by the City in a timely manner.
Recyclables must fit inside the recycling container; additional recyclables will not be picked up by the City. The resident can either wait until the next curb- side collection or drop-off recyclables at one of the City’s recycling drop-off locations.
   C.   Commingled: Residents of single dwellings, multi-dwellings, or other buildings as authorized by the Director of Public Works, may participate in the City’s plan of no-sort recycling. The City Council will by resolution designate recyclable materials which may be commingled from the normal garbage, rubbish and waste material collection if the materials have not been contaminated (a detailed recyclables list and a copy of the resolution is located on the City of Moorhead website).
   D.   Collection Of Commingled Materials: The collection of commingled materials shall be at such regular times as set by the City. Materials shall only be collected if set out in special recycling containers provided by the City and commingled as described in subsection C of this section.
   E.   Recycling Drop-Off Sites: Various recycling drop-off sites are located throughout the City. Residents are also authorized to drop-off recyclables at these locations; however, the material must be separated and placed in the appropriately marked dumpster. Drop-off locations are serviced through a contract agreement with a private business authorized by the City Council. The following materials may be separated from the normal garbage, rubbish and waste material collection if the materials have not been contaminated (a detailed recyclables list is located on the City of Moorhead website):
      1.   Newspaper: Includes inserts, shoppers, or other publications printed on newspaper stock.
      2.   Magazines: Glossy publications less than one inch (1") thick.
      3.   Rinsed clear and colored glass bottles, jugs, or jars; glass does not need to be separated from color.
      4.   Aluminum, tin and steel cans.
      5.   #1-7 plastics without rings, caps or lids.
      6.   Flattened corrugated cardboard.
   F.   Rates: Any additional fee or rate, or discount, if any, for garbage collection for persons who participate in the collection of recyclable materials under this section shall be as established by the City’s fee schedule.
   G.   Anti-Scavenging Clause: Ownership of separated materials set out for collection by the City shall be vested in the City. It shall be unlawful and an offense against this section for any person, firm or corporation to pick up separated materials for his/her own use, except the owner, lessee or occupant of a residential dwelling may take back materials set out at that particular dwelling.
   H.   Corrugated Cardboard Recycling At Business Establishments: Business establishments may participate in the City’s Corrugated Cardboard Recycling Program. Business establishments shall contract directly with a private waste hauler/recycler to provide collection and disposal of corrugated cardboard.
The containers to be used for the Corrugated Cardboard Recycling Program at business establishments shall be rented from the City by private waste haulers/recyclers. Said containers shall be the only containers used by owners or operators of business establishments within the City to dispose of corrugated cardboard recyclable materials. The containers will not be allowed on streets or boulevards. The containers shall be maintained and kept clean in accordance with the City’s public health and sanitary regulations in this title as such regulations may be from time to time amended, supplemented or replaced. The containers shall be located so as to: 1) not create a nuisance condition, 2) be out of the sight from eye level view from the public right-of-way and 3) comply with all applicable setback requirements and easements.
The City will invoice the private waste hauler/recycler for rental of the corrugated cardboard container. Any charges or details concerning collection and disposal or rebates for corrugated cardboard materials shall be determined between the business establishment and private waste hauler/recycler.
All monthly reports as set forth in subsection 3-4-5B of this chapter will be required of the private waste hauler/recycler. (Ord. 2017-08, 7-10-2017; amd. Ord. 2023-02, 3-13-2023)
