A. Restrictions. The Moorhead Public Service Commission does not have the authority to discontinue Water or Electrical Service to a premise for nonpayment or for delinquent bills relating to General Municipal Services, including forestry and vector control services, except as set forth under this chapter.
B. Collection Remedies. The Moorhead Public Service Commission shall offer a payment agreement for the payment of charges relating to General Municipal Services that are in arrears. Payment agreements must consider an Account Holder's financial circumstances using MN Cold Weather requirements regarding household income and State median income as a guide, and any extenuating circumstances. Unpaid charges may be recovered in a civil action against the Account Holder.
C. Unpaid Charges for General Municipal Services May be Levied as Special Assessments. The Moorhead Public Service Commission will provide the city with information necessary for the collection of unpaid special charges, including the amount unpaid, as a special assessment against the property benefited for all or any part of the cost of (i) operation of a street lighting system, (ii) treatment and removal of insect infested or diseased trees on private property, (iii) trimming and care of trees and removal of unsound trees from any street, or (iv) for all or any part of the costs set forth in Minn. Stat. § 429.101, Subd. 1(a), as amended from time to time. The city shall conduct the special assessment process in accordance with the procedures set forth in Minnesota law, as amended from time to time. (Ord. 2023-07, 6-26-2023)
