1-15-5: AUTHORITY TO DISCONNECT WATER AND ELECTRICAL SERVICE:
   A.   Water Service Discontinuance for Nonpayment. The Moorhead Public Service Commission has the authority to discontinue Water Service (including wastewater service, storm water service, garbage service, and street light service to a premises with a delinquent utility bill as set forth under this chapter.
   B.   Electrical Service Discontinuance for Nonpayment. The Moorhead Public Service Commission has the authority to discontinue Electrical Service to a premises with a delinquent electrical bill as set forth in this chapter.
   C.   No Liability. The Moorhead Public Service Commission reserves the right to shut off the supply of Water Service to any customer without any preliminary notice for any reason whatsoever. This includes the specific right, power, and authority to cut off the supply of water any time without incurring any liability or cause of action for damages, any regulation to the contrary notwithstanding, and the Moorhead Public Service Commission shall not be liable under any circumstances for a deficiency or failure in the supply of water as a result of shutoffs for delinquent bills. In case of fire, or alarm of fire, or in making repairs or construction of new works, water may be shut off at such time and kept off as long as necessary. In addition, the Moorhead Public Service Commission shall have the right to impose reasonable restrictions on the use of the city water system in emergency situations. (Ord. 2023-07, 6-26-2023)
