2-3-14: MINORS:
   A.   Entering Licensed Premises: It is unlawful for a person under the age of twenty one (21) years to enter an establishment licensed for the sale of alcoholic beverages within the City, except:
      1.   State Exceptions For Minors: No person eighteen (18), nineteen (19), or twenty (20) years old will be prohibited from entering an establishment licensed under this chapter to perform work for the establishment, consume meals, or attend social functions in accordance with Minnesota Statutes, section 340A.503, subdivision 4.
      2.   Local Exceptions For Minors: Except as otherwise required by this subsection A, no person under the age of twenty one (21) years may enter an establishment licensed for the sale of alcohol, except as follows:
         a.   Persons Eighteen, Nineteen, Or Twenty Years Of Age: If eighteen (18), nineteen (19), or twenty (20) years of age, a person may consume food on the premises of a liquor establishment or a restaurant and be present in the establishment for such time as that person is, in fact, purchasing and consuming food.
         b.   Restaurants: Persons under the age of eighteen (18) may purchase and consume food on the premises of a restaurant which also holds a liquor license. A "restaurant", for the purposes of this section, is defined as a public place kept, used and maintained as a place where meals are prepared, served and sold to members of the general public and where the preparation, service and sale of food or meals is the principal business from which the majority of the business income is derived, or that area of a hotel or motel which is designated as a restaurant or food service area, principally providing meals rather than alcoholic beverages. For the purposes of this section, a restaurant is not a bar, tavern, club, nightclub or any other place which has as its principal business the sale of alcoholic beverages, or the presentation of live entertainment, the playing of billiards or other amusement devices, or gambling combined together in a place where alcoholic beverages are sold.
Persons under the age of eighteen (18) years shall be present in restaurants which also hold liquor licenses only for as long as they are purchasing food, awaiting the service of food and are consuming food, unless in the company of a parent or guardian.
         c.   Clubs: Persons under the age of eighteen (18) years may, in the company of a parent or guardian, who is a member or guest of the club, purchase or consume food on the premises of a club. A "club" is as defined in section 2-3-2 of this chapter. Persons under the age of eighteen (18) shall be present in a club only for so long as purchasing or consuming food.
         d.   Bars, Nightclubs: Persons under the age of eighteen (18) years shall not be present in a bar, tavern, nightclub, or any other place which has its principal business the sale of alcoholic beverages or in any business which derives the majority of its income from the sale of alcohol along with live entertainment, billiard playing, gambling or amusement devices; except that persons under the age of eighteen (18) years may enter these establishments in the company of their parent or guardian and then only for so long as food is being purchased or consumed.
         e.   Weddings, Anniversaries, Retirement Parties: When social functions that relate to the celebration of a wedding, an anniversary of marriage or retirement party are held in an establishment licensed for the sale of alcohol, persons under the age of twenty one (21) years may attend, but may only be present for the purpose of celebrating the occasion and not for the purpose of purchasing, being served or consuming any alcoholic beverage.
         f.   Employees: Persons under the age of twenty one (21) may be employed as an entertainer or food service worker in any establishment that holds a liquor license. Any such worker, under eighteen (18) years of age, is prohibited from serving any alcoholic beverage.
         g.   Banquet Facilities: Persons under the age of twenty one (21) years may attend, but may only be present for the purpose of attending the event for which the banquet facility is rented and not for the purpose of purchasing, being served or consuming any alcoholic beverage.
   B.   Providing Alcohol To Minors: No person shall furnish intoxicating liquor or 3.2 percent malt liquor to a person under the age of twenty one (21) years, nor shall any persons allow such person under the age of twenty one (21) years to consume or possess intoxicating liquors or 3.2 percent malt liquors in any residential, multiple dwelling unit, hotel or motel room or any other premises under their control or supervision, except that the parent or guardian of such persons under the age of twenty one (21) years may furnish such intoxicating liquor or 3.2 percent malt liquor to such persons in their own residence and as otherwise permitted by State law.
   C.   Minor Consuming Or Possessing Offense:
      1.   It is unlawful for any person under the age of twenty one (21) years to possess an alcoholic beverage, or to have consumed an alcoholic beverage in any place other than the household of the person's parent or guardian with the consent of the parent or guardian.
      2.   It shall be unlawful for a person under the age of twenty one (21) years to have any measurable amount of alcohol in their system. A measurable amount of alcohol is any such amount of alcohol as is shown by testing on a breath testing device, including portable breath testing devices such as alco-sensor, or on an intoxilyzer, or by analysis of a blood or urine sample for alcohol.
