(A) It shall be the responsibility of the permit holder to maintain all cuts made within the roadway surface until the town’s Street Department resurfaces or reconstructs the roadway. There shall be no time limit on this responsibility.
(B) There shall be no permits issued under this subchapter affecting any street or roadway which has been resurfaced within two years from the date of said permit application. This section shall not apply in the case of an emergency which threatens the public safety or damage to property.
