(A) Should any defect occur in any private water carriage sewage disposal system or privy which would cause said sewage disposal system or privy to fail to meet the requirements in §§ 52.081 and 52.082(A) of this code, the defect shall be corrected immediately by the owner or agent of the owner, occupant or agent of the occupant at no expense to the town.
(B) Failure on the part of the owner or agent of the owner, occupant or agent of the occupant to do so shall be a violation of this subchapter, and he or she shall be subject to the penalties prescribed in § 52.999 of this code.
