§ 52.004 GENERAL SEWER USE REQUIREMENTS.
   (A)   National categorical pretreatment standards.
      (1)   National categorical pretreatment standards as promulgated by the U.S. Environmental Protection Agency (EPA) must be met by all dischargers of the regulated industrial categories if they are more stringent than state or local standards. It is important to understand that federal standards are required to be met at the point of discharge from the industrial pretreatment system prior to mixing with any other waste stream.
      (2)   An application submitted by the POTW for modification of categorical standards may be considered by the regional administrator if the Authority’s wastewater treatment system achieves consistent removal of regulated pollutants as defined by 40 C.F.R. § 403.7.
   (B)   State requirements. State requirements and limitations on discharges to the POTW shall be met by all dischargers which are subject to such standards in any instance in which they are more stringent than federal requirements and limitations or those in this or any other applicable ordinance.
   (C)   Right of revision. The Authority reserves the right to amend this chapter to provide for more stringent limitations or requirements on discharges to the POTW where deemed necessary to comply with objectives set forth in this chapter.
   (D)   Dilution. No discharger shall increase the use of potable or process water in any way, nor mix separate waste streams for the purpose of diluting a discharge as a partial or complete substitute for adequate treatment to achieve compliance with the standards set forth in this chapter.
   (E)   Compliance with other provisions. All provisions of this chapter and limits set herein shall comply with any applicable state or federal requirements now, or projected to be in effect.
   (F)   Records. Records of all monitoring data, dates of samples, results, who performed test, who took samples and other pertinent data must be retained at the POTW for a period of three years.
   (G)   Removal credits. Where applicable, the Authority may elect to initiate a program of removal credits as part of this chapter to reflect the POTW’s ability to remove pollutants in accordance with 40 C.F.R. § 403.7.
   (H)   Net/gross calculations. The Authority may elect to adjust categorical pretreatment standards to reflect the presence of pollutants in the discharger’s intake water, in accordance with 40 C.F.R. § 403.15.
