Any person aggrieved of any officer, department, board or agency of the Town affected by any decision or interpretation of the building official in connection with the interpretation of any of the provisions of this title may appeal to the Town Board of Adjustment, which shall be the Town Trustees; provided, that: (2011 Code § 4-7)
A. Such appeal shall be taken within ten (10) days from the date of decision by filing with the building official and the Town Clerk-Treasurer a written notice of appeal specifying the grounds thereof and by paying a filing fee as provided in the fee schedule adopted by resolution of the Town Board of Trustees at the Office of the Town Clerk-Treasurer at the time the notice is filed. B. The Town Clerk-Treasurer, upon receipt of the notice of appeal, shall transmit to the Board of Adjustment the papers and information constituting the record upon which the action appealed from was taken.
C. The Board of Adjustment shall fix a time for hearing of appeal. It shall give written notice to the parties in interest at least five (5) days before the date set for the hearing. Such notice shall contain the date, the hour and the place for the hearing. The Board of Adjustment will also post notice of the date, time and place of the hearing in two (2) public places within the Town. Upon the hearing, parties in interest may appear in person or by agent or attorneys. (2011 Code § 4-7)
