8-2-9: TRIMMING TREES:
   A.   1. Every owner of any tree overhanging any street or right-of- way within the Town shall trim the branches so that such branches shall not obstruct the light from any street lamp or obstruct the view of any street intersection and so that there shall be a clear space of eight feet (8') above the surface of the street or right-of-way. (2011 Code § 1-90)
      2.   Any owner or occupant who fails, refuses, or neglects to trim trees and shrubbery as provided in subsection A1 of this section, after receiving five (5) days' notice from the Town Code official or the Chief of Police to do so, shall be guilty of an offense against the Town. Every day on which the owner or occupant fails, refuses or neglects to trim such trees or shrubbery, after the expiration of the five (5) days' notice, shall be a separate offense. (2011 Code § 20-2)
   B.   The owners shall remove all dead, diseased or dangerous trees, or broken or decayed limbs which constitute a menace to the safety of the public.
   C.   The Town shall have the right to trim any tree or shrub on private property when it interferes with the proper spread of light along the street from a streetlight, or interferes with visibility of any traffic control device or sign, such trimming to be confined to the area immediately above the right-of-way.
