1313.13 INSPECTIONS.
   (a)   Enforcement. The Housing Inspector and such persons as he may designate shall enforce the provisions of this chapter.
   (b)   Inspection. The Housing Inspector shall inspect dwellings and dwelling units in order to determine whether there is compliance with this chapter. Such inspection shall be between the hours of 8:00 a.m. and 5:00 p.m. unless otherwise requested by the owner or occupant.
   (c)   Basis for Inspections. Inspections as set forth above shall be conducted as follows:
       (1)   Request to inspect. The Housing Inspector shall inspect any dwelling, dwelling unit, or multiple dwelling unit when requested to do so by the owner, occupant, or other person having probable cause to believe that this chapter is being violated. Prior to any inspection by the Housing Inspector, the complaining party shall give notice as follows:
         A.   Complaint by owner; notice to tenant. If the complaining party is the owner, the owner shall notify the tenant of the problems complained of by certified mail, return receipt requested, with a copy of said letter going to the Housing Inspector.
         B.   Complaint by tenant; notice to owner. If the complainant is the tenant, the tenant shall send the owner a written letter setting out the problems, the said letter to be by certified mail, return receipt requested, and a copy of said letter to be furnished to the Housing Inspector.
         C.   Third party complaint; notice to owner and tenant. If the complaining party is not the owner nor occupant, the complaining party shall send a notice by certified mail, return receipt requested, to the owner and to the tenant setting forth the problems. A copy of the said notice shall be sent to the Housing Inspector.
         D.   Duty of inspector. Not sooner than ten days after receiving a copy of the letter alleging violations of this chapter, the Village Housing Inspector shall make inquiry of the parties involved and, if satisfied that the problems have been resolved, shall take no further action. If the problems have not been resolved and upon notice to the owner and occupant, and, in the case where the complainant is not the owner or occupant, shall determine that probable cause exists to believe that a violation of this chapter has or is occurring, shall make an inspection of the premises.
   (d)   Access Refused; Court Order. If any owner, occupant, or operator of a dwelling fails or refuses to allow free access and entry to the structure or premises under his control, or any part thereof, with respect to which an inspection authorized by this chapter is sought to be made, the Inspector may secure an order of a court of competent jurisdiction directing compliance with the inspection requirements of this section.
