(a) For purposes of this section, the following definitions shall apply.
(1) “Backflow” means the flow of water or other liquids, mixtures, or substances into the distributing pipes of a potable water supply from any source other than the intended source of the portable water supply.
(2) “Backflow prevention device” means any device, method, or type of construction approved by the Ohio Environmental Protection Agency that is intended to prevent backflow into a potable water system.
(3) “Cross-connection” means any arrangement whereby backflow can occur.
(4) “Human consumption” means the ingestion or absorption of water or water vapor as the result of drinking, cooking, dishwashing, hand washing, bathing, showering, or oral hygiene.
(b) The drilling of water wells for the purpose of obtaining water for human consumption is prohibited within the Village.
(c) The drilling and use of water wells for any purpose other than obtaining water for human consumption, including without limitation, geothermal heating or cooling, industrial processes such as cooling, or fire protection, is prohibited within the Village unless the owner of the property on which such well is to be drilled has obtained a permit from the Village Manager.
(1) In order to obtain a permit for the drilling and use of a water well for any purpose other than obtaining water for human consumption, the owner of the property on which such well is to be drilled must comply with the following.
(2) At least 30 days prior to drilling any water well, the owner of the property on which such well is to be drilled must submit an application for a permit from the Village Manager.
A. The application shall state the name and address of the owner, the nature of the well to be placed, the location of the well, the intended use of the well, the expected supply capacity of the well, the date on which the owner is requesting the drill, the identity of the driller.
B. The application should include a statement from the owner acknowledging that cross-connections to the public water supply are prohibited. The application should identify any backflow prevention devices to be used or include an explanation of why such backflow prevention devices are not necessary for the protection of the public water supply.
C. The application must include an explanation of why use of the public water supply is not reasonable under the circumstances. The Village may require that the explanation be supported by studies, reports, cost estimates, or other appropriate evidence.
(3) The application for a permit shall be denied unless the applicant has demonstrated the following:
A. The drilling and use of the well will not adversely affect the public water supply.
B. Use of the public water supply for the purposes described in the permit is not reasonable under the circumstances, which include without limitation the feasibility of connecting to the public water supply, the capacity available, the cost associated with use of the public water supply, and the prior or existing use of other water wells on the property.
(4) All water obtained from any such water well shall be used on the premises where the well is located. No water shall be transported for use at another location.
(5) Any water drawn from the well shall be discharged in an uncontaminated condition in a method approved by the Village Manager.
(6) The use of the water well and the discharge of any water from the well must comply with all applicable local, state, and federal laws, rules, and regulations.
(7) Cross-connections to the public water supply are prohibited.
(8) The Village Manager may require the use of backflow prevention devices as a condition of approving the permit for the drilling of the well or as a condition of using a water well that has already been drilled. Nothing in this section is intended to supersede the provisions in Section 933.14.
