929.99 PENALTY.
   (a)   Any owner, agent, lessee, tenant or occupant of any lot or land located within the Village who establishes, constructs, or installs a septic tank, privy, cesspool, or other receptacle for sewage or excreta when a public sewer is accessible shall be deemed guilty of a misdemeanor of the third degree and each day’s violation shall constitute a separate offense.
   (b)   Any owner, agent, lessee, tenant or occupant who violates the provisions of Section 929.01(b) shall be deemed guilty of a minor misdemeanor and each day’s violation shall constitute a separate offense.
   (c)   Any owner, agent, lessee, tenant or occupant of any lot or land in the Village who violates Section 929.01(c)(1) shall be deemed guilty of a misdemeanor of the third degree and each day’s violation shall constitute a separate offense.
   (d)   Any owner, agent, lessee, tenant or occupant who violates Section 929.02(a)(1) shall be deemed guilty of a minor misdemeanor and each day’s violation shall constitute a separate offense.
   (e)   Any owner, agent, lessee, tenant or occupant who violates any regulation established by the Manager pursuant to Section 929.05 shall be guilty of a minor misdemeanor and each day’s violation shall constitute a separate offense.
   (f)   Any owner, agent, lessee, tenant or occupant who violates any other provisions of this chapter shall be deemed guilty of a minor misdemeanor and each day’s violation shall constitute a separate offense.
   (g)   In addition to the foregoing, the Village may also impose the following sanctions and/or seek the following remedies:
      (1)   Termination of water supply upon failure to connect with public sewer or upon delinquent payments.
         A.   Since the sewer service charge is based on water consumption and the maintenance of the sewer system is dependent on funds obtained from the sewer service charges, the Village may terminate the water supply to any property owner who has not complied with the notice to connect with the public sewer as provided in this chapter.
         B.   The Village will not accept payment of any water bill without payment also of the sewer bill, and if any water or sewer bill remains unpaid for thirty days, the Village may terminate the water supply to such property owner until the water and sewer bill is paid.
      (2)   Liability of person violating provisions. In addition to the other penalties provided herein, any person violating any of the provisions of this chapter or any regulations made pursuant to this chapter or regulation shall become liable to the Village for any expense, loss or damage occasioned the Village by reason of such violation.
      (3)   Injunction proceedings. The Village may also prevent or stop violations of this chapter or any regulations made pursuant to this chapter by injunction proceedings in the appropriate court.
   (h)   Upon a showing of probable cause to believe that an offense in violation of this chapter has occurred or is occurring, the Village Manager and/or the Village Police may secure a search warrant from the appropriate Williams County court to enter the premises and secure evidence of such offense.
