2-2-9: STANDARDS FOR REVIEW OF VARIANCE REQUESTS; DECISION ON VARIANCE REQUESTS:
   A   Such requests for variance must be made by completing a written application and submitting it, along with the application fee, to the zoning administrator within thirty (30) days of the land use authority's decision.
   B   Within fifteen (15) days of filing of such request, the board of adjustment hearing date shall be fixed. This date shall be the earliest a quorum can be convened and the time set at six thirty o'clock (6:30) P.M.
   C   The board of adjustment may grant a variance only if all five (5) of the following conditions are met as per state law:
      1   Literal enforcement of the ordinance would cause an unreasonable hardship for the applicant that is not necessary to carry out the general purpose of the land use (zoning) ordinances;
      2   There are special circumstances attached to the property that do not generally apply to other properties in the same zone;
      3   Granting the variance is essential to the enjoyment of a substantial property right possessed by other property in the same zone;
      4   The variance will not substantially affect the general plan and will not be contrary to the public interest; and
      5   The spirit of the land use (zoning) ordinance is observed and substantial justice done.
   D   In determining whether or not enforcement of the land use (zoning) ordinance would cause unreasonable hardship under subsection C1 of this section, the board of adjustment may not find an unreasonable hardship unless the alleged hardship:
      1   Is located on or associated with the property for which the variance is sought; and
      2   Comes from circumstances peculiar to the property, not from conditions that are general to the neighborhood.
   E   In determining whether or not enforcement of the land use (zoning) ordinance would cause unreasonable hardship under subsection C1 of this section, the board of adjustment may not find an unreasonable hardship if the hardship is self-imposed or economic.
   F   In determining whether or not there are special circumstances attached to the property under subsection C2 of this section, the board of adjustment may find that special circumstances exist only if the special circumstances:
      1   Relate to the hardship complained of; and
      2   Deprive the property of privileges granted to other properties in the same zone.
   G   The applicant shall bear the burden of proving that all of the conditions justifying a variance have been met.
   H   Variances run with the land.
   I   The board of adjustment may not grant a use variance.
   J   In granting a variance, the board of adjustment may impose additional requirements on the applicant that will:
      1   Mitigate any harmful affects of the variance; or
      2   Serve the purpose of the standard or requirement that is waived or modified. (Ord. 2009-13, 3-24-2009, eff. 4-13-2009)
