A The powers and duties of the board of adjustment shall be to hear and decide:
1 Requests for variances from the terms of the land use (zoning) ordinances of the city of Monticello; and
2 Appeals from decisions applying the land use (zoning) ordinances.
B The board of adjustment:
1 Shall:
a Act in a quasi-judicial manner; and
b Serve as the final arbiter of issues involving the interpretation or application of land use ordinances; and
2 May not entertain an appeal of a matter in which the board of adjustment, or any participating member, had first acted as the land use authority.
C Any adversely affected party must present to the board of adjustment every theory or relief that it can raise in district court.
D The board of adjustment will convene only if a quorum (at least 3) of its members is present.
E The board of adjustment will only act upon the vote of a majority of its convened members. (Ord. 2009-13, 3-24-2009, eff. 4-13-2009)
