The provision and sale of utility services outside city limits:
A The city has a responsibility to meet the requirements of water users within the city limits, as well as those connected to the service within the future annexation area, however, in times of water shortage service to all such users may be curtailed.
B The city reserves the right to deny any application for connection to city utility lines, based on known or anticipated factors which might be considered detrimental to the city.
C The city has no obligation to extend, construct, or in any way provide water or sewer lines in addition to those already in existence.
D The applicant must agree to pay, in advance, the entire expense for extension of water and sewer lines or cause the lines to be constructed at the applicant's expense.
E The extended lines must be installed by a licensed contractor, according to city specifications, and must pass inspection by the city public works director and city engineer prior to final approval and acceptance by the city.
F The extended lines must be sized to meet the needs of future planned growth and infrastructure expansion as approved by the city public works department.
G The extended lines must be placed to meet the city's future planned growth and infrastructure needs, with consideration given to the Monticello city general plan and future road corridors, as reviewed and approved by the zoning administrator.
H When complete, any water main extensions must be surrendered to city ownership along with all appropriate easements and rights of way.
I The extension must be individually reviewed and approved by the city council.
J The applicant must agree to pay an additional fee for the provision of services outside city limits, with rates to be reasonably set and justified by the city council.
K Should the city institute an annexation which would include the property of the applicant, the applicant must agree not to resist or otherwise oppose such annexation.
L Water users outside the city limits will be required to follow the same watering use restrictions as all other water users serviced by the city of Monticello.
M All of the above stipulations will be provided for in an agreement to be signed by the applicant and submitted to the city council for consideration. (Ord. 2010-03, 6-8-2010)
