Every sidewalk café shall be operated in strict conformance with the following requirements.
(A) The conditions, operation, and restrictions shall be met on a continuing basis. No expansion of the area occupied by the sidewalk café from that shown on the license application shall be made.
(B) Only food or beverages for immediate consumption shall be offered for sale.
(C) Intoxicating liquors, beer, or wine may be consumed only if the sidewalk café meets all of the requirements of Chapter 110.
(D) The sidewalk café shall be maintained in a clean and sanitary condition. Sidewalks will be required to be swept and washed daily by the permit holder and trash disposal and electricity will be provided from within the establishment.
(E) The person holding the sidewalk café license shall, at such person’s expense, promptly repair any damage to public property resulting, in whole or in part, from the operation of the sidewalk café.
(F) Any public sidewalk between the eligible venue and the sidewalk café shall, at all times, remain open for public traffic, subject to ingress and egress between the eligible venue and its sidewalk café.
(G) No sale or service shall be permitted in any portion of the street designated for vehicular traffic.
(H) Hours of operation of the sidewalk café shall be limited to between 10:00 a.m. and 10:00 p.m. from April 15 through October 15.
(I) No electronically amplified outdoor music, intercom, audio speakers, or other such noise generating devices shall be allowed in the sidewalk café area.
