For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ELIGIBLE VENUE.
(1) A restaurant currently holding a license from the Minnesota Department of Health that was issued pursuant to M.S. § 157.16, subd. 1, as it may be amended from time to time;
(2) A premises currently holding an on-sale intoxicating liquor license that was issued pursuant to Chapter 110 of this code of ordinances;
(3) A premises currently holding a wine license that was issued pursuant to Chapter 110 of this code of ordinances; or
(4) A premises currently holding a brewery, taproom or brew pub license that was issued pursuant to Chapter 110 of this code of ordinances.
MUNICIPAL PARKING LOT. A parking lot owned by the city that is generally available for use by the public for vehicular parking.
PUBLIC SIDEWALK. A sidewalk owned by the city that is generally available for use by the public for pedestrian traffic.
RESTAURANT. The meaning given it by M.S. § 157.15, subd. 12, as it may be amended from time to time.
SIDEWALK CAFÉ. Tables, chairs, benches, and appurtenant equipment located on a public sidewalk or municipal parking lot:
(1) For the exclusive or non-exclusive use by patrons of an abutting, eligible establishment as allowed by the license; and
(2) Where the service of food or beverages is offered to persons using such tables, chairs, and benches.
