(A) The Board shall exercise the powers and carry out the duties in managing, controlling and operating all city parks as are granted by the laws of the State of Indiana, subject to the fiscal powers and responsibilities reserved to the Common Council.
(B) In addition to the duties set forth in IC 36-10-3-10, the Board shall also be empowered to exercise all powers permitted under IC 36-10-3-11, subject to appropriations for expenditures budgeted by the City Council.
(C) The Board may accept gifts, donations and subsidies pursuant to IC 36-10-3-18, and subject to the provisions thereof. However, notwithstanding any provision herein to the contrary, a minimum of 10% of any such gift, donation or subsidy consisting of monies to be used for purchase of property shall be held in reserve by the Board for the maintenance of the property so purchased, so long as such a reserve is not prohibited by the conditions of any such gift, donation or subsidy.
