§ 90.08 IMPOUNDING.
   (A)   An animal is hereby declared to be a nuisance, and may be taken up and impounded:
      (1)   That is unlawfully running at large or is otherwise declared to be a nuisance by §§ 90.02 or 90.03 of this chapter;
      (2)   Which may in any manner unduly disturb the quiet of any person or neighborhood within the city;
      (3)   Which bites any person or injures any person so as to cause an abrasion of the skin; or
      (4)   That is a dog that commits acts or behaves in a manner within the definition of a “dangerous dog” and/or a “vicious dog”, as defined by the Illinois Animal Control Act, ILCS Ch. 510, Act 5, §§ 1 et seq.
   (B)   (1)   Dogs or cats may be impounded by taking them to the animal hospital located at the present time on West Bridge Street in the City of Monticello, Illinois. The owner or keeper of any dog or cat so impounded who desires to make a redemption thereof is hereby required to:
         (a)   Pay the fees of the veterinarian and for the keeping of the dog or cat before the dog or cat is released, at the regular rates charged for those services by the veterinarian in charge; and
         (b)   Pay a $25 public safety fine to be deposited into the State of Illinois’ Pet Population Control Fund, unless it is the dog’s or cat’s first impoundment and the owner or keeper has the animal spayed or neutered within 14 days; and
         (c)   Pay for microchipping and registration if not already done.
      (2)   In effecting the capture of a dog or cat or dogs or cats running at large, officers are authorized and directed to use traps, nets, or tranquilizer guns.
   (C)   Unclaimed stray dogs or cats will be kept for a period of 5 days and then either adopted or otherwise disposed of. The city’s only responsibility on such stray and unclaimed dogs and cats would be to pay the veterinarian and animal hospital for 5 days’ board.
   (D)   A dog that commits acts or behaves in a manner within the definition of a “dangerous dog” and/or a “vicious dog” may be reported to the County Animal Control Administrator, for possible investigation under the Illinois Animal Control Act, ILCS Ch. 510, Act 5, §§ 1 et seq.
   (E)   If there appears to be imminent danger to the public, any dangerous animal found not in compliance with the provisions of § 90.07 shall be subject to seizure and may immediately be placed in an approved facility. Upon the conviction of a person for a violation of this section, the animal with regard to which the conviction was obtained shall be confiscated and placed in an approved facility, with the dangerous animal owner responsible for all costs connected with the seizure and confiscation of the animal. Approved facilities include, but are not limited to, a zoological park, federally licensed exhibit, humane society, veterinary hospital or animal refuge.
