§ 152.096 RESPONSIBILITY OF PERMITTEE.
   The permittee shall maintain a copy of the permit, approved plans and reports required under the permit on the work site and available for inspection by the Superintendent of City Services, or his or her representative, during all working hours. The permittee, at all times, shall ensure that the property is in conformity with the approved grading plan, erosion and sediment control plans, and the permittee shall also conform to the following:
   (A)   General. Notwithstanding other conditions or provisions of the permit, or the minimum standards set forth in these regulations, the permittee is responsible for the prevention of damage to adjacent property and persons arising from land disturbance activities. No person shall grade on land in any manner, or so close to the property line as to endanger or damage any person or adjoining public street, sidewalk, alley or any other public or private property without supporting and protecting such property from settling, cracking, erosion, sedimentation or other damage or personal injury which might result.
   (B)   Public ways. The permittee shall be responsible for the prompt removal of any soil, miscellaneous debris or other materials washed, spilled, tracked, dumped or otherwise deposited on public streets, highways, sidewalks, public thoroughfares or public sanitary or storm water conveyance systems, by the construction activity, or during transit to and from the construction site, and shall promptly correct any damages resulting therefrom. All public ways shall be free of any soil or miscellaneous debris from or relating to the construction site prior to the issuance of a certificate of occupancy.
