§ 31.30 DIRECTOR OF PUBLIC WORKS.
   (A)   Creation of office. There is hereby created the Office of Director of Public Works, an executive office of the city.
   (B)   Qualifications. The Director of Public Works must be capable of performing all duties as set forth herein. Due to his or her requirement of technical training or knowledge, the Director of Public Works need not be a qualified elector of the city nor a resident prior to his or her employment. No person who is a defaulter to the city shall be eligible to the Office of Director of Public Works.
   (C)   Bond. Before entering upon his or her duties of office, the Director of Public Works shall execute a bond in the amount of $5,000 conditioned upon the faithful performance of his or her duties. The bond shall be filed with the City Clerk. The cost of the bond shall be paid for by the city.
   (D)   Duties.
      (1)   The Director of Public Works shall perform such duties in addition to those which may be prescribed by statute and be subject to any other rules and regulations as the corporate authorities may provide by ordinance;
      (2)   The Director of Public Works shall supervise the lighting of the public streets and alleys and shall keep the lighting system in efficient operation and good repair;
      (3)   The Director of Public Works shall see that all sewers in the city are kept in good repair and free from obstructions and breaks and shall make all inspections necessary to enforce the ordinance relating to the sewers;
      (4)   The Director of Public Works shall be charged with the duty of keeping the streets and alleys clean and free from obstructions and in good repair. He or she shall see that all street drains and sewers are free and unobstructed and shall perform any other duties as may be required by the corporate authorities;
      (5)   The Director of Public Works shall have charge of the construction and maintenance of all water pipes in the city. He or she shall have charge of the maintenance of the water works system;
      (6)   The Director of Public Works shall have charge of the maintenance and operation of the sewage disposal plant;
      (7)   The Director of Public Works shall review annexations, plats, and other development proposals for impact on Public Works services;
      (8)   The Director of Public Works shall develop and approve operating procedures based upon established policies;
      (9)   The Director of Public Works shall monitor critical performance elements of services provided by the Department to help assure effective and efficient operation and to identify opportunities for improvement;
      (10)   The Director of Public Works shall review key operations and activities in the field at regular intervals to see that performance standards are met;
      (11)   The Director of Public Works shall plan, implement, and revise goals, objectives, and standards established for Public Works activities;
      (12)   The Director of Public Works shall provide long-range planning to establish future equipment and manpower needs, and update this annually;
      (13)   The Director of Public Works shall maintain a safety program conducted pursuant to the safety program plan;
      (14)   The Director of Public Works shall maintain a safe work environment in all areas under direct supervision;
      (15)   The Director of Public Works shall develop, recommend, and administer the departmental budget in conjunction with the Superintendent of City Services;
      (16)   The Director of Public Works shall participate in drafting contracts for Public Works services;
      (17)   The Director of Public Works shall be responsible for the overall management of all City Public Works operations and activities;
      (18)   The Director of Public Works shall plan, delegate, assign, and evaluate the work of all leadsmen and Public Works personnel;
      (19)   The Director of Public Works shall direct and oversee the administration of disciplinary action as necessary according to city personnel policy;
      (20)   The Director of Public Works shall perform duties as covered by the ESDA plan;
      (21)   The Director of Public Works shall provide technical services to the Emergency Services and Disaster Agency (ESDA);
      (22)   The Director of Public Works shall have knowledge of municipal and departmental budgeting procedures;
      (23)   The Director of Public Works shall have the ability to develop long-term plans and programs and to make sound decisions on matters of operating policy and administrative problems;
      (24)   The Director of Public Works shall have knowledge of employee relations, including labor relations;
      (25)   The Director of Public Works shall have the ability to meet tactfully and effectively with public officials, professionals, and the general public and to present ideas clearly and concisely in oral and written form;
      (26)   The Director of Public Works shall perform other related duties and tasks assigned by the Superintendent of City Services and City Council; and
      (27)   The Director of Public Works, in conjunction with the Superintendent of City Services, shall act as the purchasing agent for the city and will issue a purchase order for any/and all purchases over $50.
   (E)   Employees. All employees of the Department of City Services shall perform their duties subject to the orders and under the supervision of the Director of Public Works.
   (F)   Compensation. The City Council shall fix the salary of the Director of Public Works in the annual appropriation ordinance. The salary shall neither be increased nor diminished during the fiscal year in which the appropriation is made.
   (G)   Prohibition against pecuniary interests. Unless otherwise provided by statute, the Director of Public Works shall not be interested, directly or indirectly, in his or her own name or in the name of any person, association, trust, or corporation, in any contract, work, or business of the municipality, or in the sale of any article whenever the expense, price, or consideration of the contract, work, business, or sale is paid either from the treasury or by any assessment levied by any statute or ordinance. The Director of Public Works shall not be interested, directly or indirectly, in the purchase of any property which:
      (1)   Belongs to the municipality;
      (2)   Is sold for taxes or assessments; or
      (3)   Is sold by virtue of legal process at the suit of the municipality, unless specifically so provided by statute.
