The owner or developer of property desiring to install public improvements in an area depicted on a proposed or approved preliminary plan, or approved or proposed final subdivision plat, shall perform the installation in accordance with the following procedure:
(A) Prerequisites to installation.
(1) Approval of a final plat; and
(2) Posting of a final plat, public improvement payment, performance and workmanship bond and security therefor, in the amount and form specified in § 152.065 for all public improvements depicted in, adjacent to or necessary to serve lots or outlots depicted in an area for which final plat approval has been obtained.
(B) Construction observation. During installation of public improvements, either before or after final plat approval, the owner or developer shall comply with the requirements of Sec. 1.13 of A Manual of Practice for the Design of Public Improvements in the City of Monticello. Failure to comply and install or maintain the installations in a manner that permits construction observation shall constitute grounds for rejecting or revoking preliminary plan or final plat approval, forfeiting pledged security and, in addition, shall constitute a violation of this chapter; and
(C) Plan review and observation and testing fee. The cost incurred by the city pursuant to § 152.042 shall be paid by the owner or developer prior to final acceptance of the land improvements. The certifying or design engineer shall provide for 100% construction inspection as well as provide for all testing and associated fees necessary to ensure compliance with A Manual of Practice for the Design of Public Improvements in the City of Monticello. All land improvements to be installed under the provisions of this code may, at any time, be inspected and tested by the city during the course of construction. The Superintendent of City Services or the City Inspector shall stop all construction activities upon knowledge of noncompliance with this code until the noncompliance can be remedied.
