§ 31.17 ALDERPERSONS.
   (A)   Office created. There is hereby created the Office of Alderman/Alderperson. There shall be 8 Alderpersons on the City Council or such other number as determined by law. Alderpersons shall be qualified and elected, and shall have the powers and duties prescribed by law.

   (B)   Number. There shall be 8 Alderpersons on the City Council, until the time that that number is modified by statute or election.

   (C)   Wards. The city shall have 1/2 as many wards as the total number of Alderpersons to which the city is entitled. The City Council, from time to time, shall divide the city into that number of wards. In the formation of wards, the number of inhabitants of the city eligible to vote at the general election for city officers immediately preceding the division of the city into wards shall be as nearly equal in population and the wards shall be of as compact and contiguous territory as practical. The City of Monticello is divided into 4 wards. The boundaries of each ward are as follows:
      (1)   First Ward. All annexed properties within the corporate boundaries of the City of Monticello within the following described boundary. Beginning at the intersection of the City of Monticello westerly corporate limits and the centerline of Bridge Street; thence proceeding easterly along said Bridge Street centerline to the intersection of the centerline of Bridge Street and the centerline of Foothill Road; thence proceed northerly along the centerline of Foothill Road to the intersection of the centerline of Foothill Road and the centerline of Bell Avenue; thence proceed easterly along the centerline of Bell Avenue Road to the intersection of the centerline of Bell Avenue Road and the centerline of Front street; thence proceed northerly along the centerline of Front Street to the intersection of the centerline of Front Street and the centerline of Wilson Street; thence proceed easterly along the centerline of Wilson Street to the intersection of the centerline of Wilson Street and the centerline of Union Drive; thence proceed northerly along the centerline of Union Drive to the intersection of the centerline of Union Drive and the centerline of North Street; thence proceed easterly along the centerline of North Street to the easterly corporate limits of the City of Monticello; thence beginning in a northerly direction proceed along the corporate boundary line, in a generally counterclockwise manner, to the point of the beginning.
      (2)   Second Ward. All annexed properties within the corporate boundaries of the City of Monticello within the following described boundary. Beginning at the intersection of the City of Monticello easterly corporate limits and the centerline of Robert Webb Street; thence proceeding westerly along the centerline of Robert Webb Street to the intersection of the centerline of Robert Webb Street and the centerline of Piatt Street; thence proceed northerly along the centerline of Piatt Street to the intersection of the centerline of Piatt Street and the centerline of Marion Street; thence proceed westerly along the centerline of Marion Street to the intersection of the centerline of Marion Street and the centerline of Buchanan Street; thence proceed northerly along the centerline of Buchanan Street to the intersection of the centerline of Buchanan Street and the centerline of Wilson Street; thence proceed easterly along the centerline of Wilson Street to the intersection of the centerline of Wilson and the centerline of Union Drive; thence proceed northerly along the centerline of Union Drive to the intersection of the centerline of Union Drive and the centerline of North Street; thence proceed easterly along the centerline of North Street to the easterly corporate limits of the City of Monticello; thence beginning in a southerly direction proceed along the corporate boundary line, in a generally clockwise manner, to the point of beginning.
      (3)   Third Ward. All annexed properties within the corporate boundaries of the City of Monticello within the following described boundary. Beginning at the intersection of the City of Monticello easterly corporate limits and the centerline of Robert Webb Street; thence proceeding westerly along the centerline of Robert Webb Street to the intersection of the centerline of Robert Webb Street and the centerline of Piatt Street; thence proceed northerly along the centerline of Piatt Street to the intersection of the centerline of Piatt Street and the centerline of Marion Street; thence proceed westerly along the centerline of Marion Street to the intersection of the centerline of Marion Street and the corporate boundary line of the City of Monticello; thence proceed southwesterly along the corporate boundary line of the City of Monticello to the point at the southwest corner of the property commonly known as 830 Allerton Road (PIN 05-00-54-001-869-00); thence south along the property boundary line from the southwest corner of the property commonly known as 830 Allerton Road (PIN 05-00-54-001- 869-00) to the southwest corner of the property commonly known as 830 Allerton Road (PIN 05-00-54-001-870-00); thence east along the property boundary line from the southwest corner of the property commonly known as 830 Allerton Road (PIN 05-00-54-001-870-00) to the northwest corner of the property commonly known as 800 Allerton Road (PIN 05-00-54-001-873-00); thence beginning in a southwesterly direction following the corporate boundary line, in a generally counter-clockwise manner to the point of beginning.
      (4)   Fourth Ward. All annexed properties within the corporate boundaries of the City of Monticello within the following described boundary. Beginning at the intersection of the City of Monticello westerly corporate limits and the centerline of Bridge Street; thence proceeding easterly along said Bridge Street centerline to the intersection of the centerline of Bridge Street and the centerline of Foothill Road; thence proceed northerly along the centerline of Foothill Road to the intersection of the centerline of Foothill Road and the centerline of Bell Avenue; thence proceed easterly along the centerline of Bell Avenue to the intersection of the centerline of Bell Avenue and the centerline of Front Street; thence proceed northerly along the centerline of Front Street to the intersection of the centerline of Front Street and the centerline of Wilson Street; thence proceed easterly along the centerline of Wilson Street to the intersection of the centerline of Wilson Street and the centerline of Buchanan Street; thence proceed south along the centerline of Buchanan Street to the intersection of the centerline of Buchanan Street and the centerline of Marion Street; thence proceed westerly along the centerline of Marion Street to the intersection of the centerline of Marion Street and the corporate boundary line of the City of Monticello; thence proceed southwesterly along the corporate boundary line of the City of Monticello to the point at the southwest corner of the property commonly known as 830 Allerton Road (PIN 05-00-54-001-869-00); thence south along the property boundary line from the southwest corner of the property commonly known as 830 Allerton Road (PIN 05-00-54-001- 869-00) to the southwest corner of the property commonly known as 830 Allerton Road (PIN 05-00-54-001-870-00); thence beginning in a westerly direction proceed along the corporate boundary line, in a generally clockwise direction, to the point of beginning.
   (D)   Resignation; vacancy. An Alderperson may resign from his or her office. A vacancy occurs in the Office of Alderperson by reason of resignation, failure to elect and qualify, death, permanent physical or mental disability, conviction of a disqualifying crime, abandonment of office or of residence from the ward. The vacancy shall be filled in accordance with state statute.
   (E)   Compensation.  
      (1)   The Alderpersons shall receive the salary, fees, or other compensation that is fixed by ordinance. After they are once fixed, the salary, fees, or other compensation shall not be increased or diminished so as to take effect during the term of the Alderperson.

      (2)   Each Alderperson of the city who is either elected or reelected after the date of passage of this section shall be paid at a rate as determined by City Council from time to time. Payments shall be made in 12 equal monthly installments.
   (F)   Prohibition against pecuniary interests. Unless otherwise provided by statute, the Alderpersons shall not be interested, directly or indirectly, in his or her own name or in the name of any person, association, trust, or corporation, in any contract, work, or business of the municipality, or in the sale of any article whenever the expense, price or consideration of the contract, work, business, or sale is paid either from the treasury or by any assessment levied by any statute or ordinance. The Alderperson shall not be interested, directly or indirectly, in the purchase of any property which:
      (1)   Belongs to the municipality;
      (2)   Is sold for taxes or assessments; or
      (3)   Is sold by virtue of legal process at the suit of the municipality, unless specifically so provided by statute.
