§ 111.046 LOCATION RESTRICTIONS.
   Unless an exemption is granted by the Local Liquor Control Commissioner, no license shall be issued for the retail sale of alcoholic liquor upon any premises within 100 feet of any church, school, hospital, or home for aged or indigent persons or for veterans, their wives and children, as measured, in the case of a church, from the nearest part of any building used for worship services or educational programs, and not from property lines, to the property line of the establishment, and in the case of all other enumerated uses, the measurement shall be from property line to property line; provided that this restriction shall not apply to regularly organized clubs, restaurants, food shops, or other places of business established prior to the taking effect of this chapter, where the sale of alcoholic liquor is not the principal business. Nor shall the restrictions set forth in this section apply to the renewal of a license on a premises within 100 feet of any church or school, when that church or school has been established within the 100 feet since the issuance of the original license. Nor shall this section prevent the issuance of a Class E license to a church, school, hospital, or home for aged or indigent persons or for veterans pursuant to § 111.031.
