§ 94.049 RESTORING SURFACE.
   (A)   Any person, firm, or corporation making any excavation or tunnel in or under any public street, alley, or public place in the city shall restore the surface thereof to its original condition if there is no pavement there. All refills shall be properly tamped down.
   (B)   Any opening in a concrete or brick paved portion of a street shall be repaired and the surface relaid by the applicant, in compliance with the ordinances and subject to the supervision of the Superintendent of City Services.
   (C)   If the opening is in a street that is surfaced by blacktop or bituminous material, the permittee shall back fill the surface with sand or gravel, and the city shall reinstall the surface of the street surfacing. The cost of the resurfacing shall be paid by the permittee.
